Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Habbly app and related services (collectively, the "Service") operated by Habbly Ltd, a company registered in the United Kingdom. By downloading, installing, or using Habbly, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Who these Terms apply to
Habbly is a language-learning platform built for teachers and their classes. The Service is used by:
- Teachers: who create the account, set up classes, assign homework, and view progress dashboards. The teacher is the account holder and the contracting party under these Terms.
- Students: who access assignments using a class code and PIN provided by their teacher
The teacher creates the account and agrees to these Terms on their own behalf. Students do not create accounts; the teacher simply shares a class code and PIN with them.
2. Eligibility
The teacher-facing dashboard is intended for adults (18+). Students access the app through a class code and PIN supplied by their teacher; they do not create accounts and do not agree to these Terms directly. The teacher is responsible for ensuring students use the Service appropriately.
If you are a teacher, you represent that you are 18 or over and have the authority to accept these Terms.
3. Teacher accounts
Account creation
Teachers create an account to access the dashboard. You may register using:
- Email with one-time password (OTP) verification
- Sign in with Google
- Sign in with Apple
Account responsibilities
- Keep your login credentials confidential
- Ensure your account information is accurate and up to date
- Notify us immediately at hello@habbly.org of any unauthorised access
- Not share your account with others or create multiple accounts for the same person
4. What the Service provides
Habbly gives teachers a way to set short language-learning homework assignments. Students complete these on their own phones. The Service includes:
- A library of ready-made homework games sorted by CEFR level and topic
- A teacher dashboard showing completion, scores, and per-skill analytics
- A student experience accessible by class code and PIN with no account required
- Automated marking and feedback using AI tools (see our Privacy Policy for detail)
We reserve the right to modify, add, or remove features at any time. We will give reasonable notice of material changes where possible.
5. Acceptable use
You agree to use the Service only for lawful educational purposes. You must not:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the Service or its servers
- Use automated systems to extract data from the Service
- Upload viruses, malware, or other harmful code
- Reverse-engineer, decompile, or disassemble the app
- Assign class codes to people outside your school or class without authorisation
6. Intellectual property
All content, features, and functionality of the Service, including lesson content, scoring logic, dashboard design, and branding, are owned by Habbly Ltd and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for educational purposes with your own classes. This licence does not include the right to:
- Copy, modify, or distribute any content from the Service
- Use our content for commercial purposes
- Remove any copyright or proprietary notices
- Create derivative works based on our content
7. Privacy and data
Your use of the Service is governed by our Privacy Policy, which explains what data we collect, why, and how we handle it, including our responsibilities under UK GDPR. Because students sign in with only a class code and PIN and the teacher chooses what display name to give each pupil, Habbly collects no directly identifying details about students. If you have any questions, contact hello@habbly.org.
8. Third-party services
The Service integrates with the following third parties (see our Privacy Policy for the full sub-processor list):
- Apple iOS Speech Recognition (subject to Apple's Terms and Conditions)

- AWS (for secure backend hosting)
We are not responsible for the terms or practices of these third-party services.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Any content is accurate or complete
- The Service will meet your specific requirements
We do not guarantee specific learning outcomes. Student progress depends on individual engagement.
10. Limitation of liability
To the fullest extent permitted by applicable law, Habbly Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, resulting from:
- Your use of or inability to use the Service
- Unauthorised access to or use of our servers or any data stored therein
- Any interruption or cessation of transmission to or from the Service
- Any errors or omissions in any content
Our total liability shall not exceed the amount you have paid to us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Habbly Ltd and its officers, employees, and affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and associated data in accordance with our Privacy Policy
- Provisions that by their nature should survive termination will do so
You may close your account at any time by contacting hello@habbly.org.
13. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, without affecting any mandatory consumer protection rights you may have under the laws of your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will:
- Update the "Last updated" date at the top of this page
- Notify you via the app or email
- Give you reasonable notice before changes take effect
Continued use of the Service after changes constitutes acceptance of the updated Terms.
